Terms of Service

Welcome to PoseFit AI. These Terms of Service ("Terms", "Agreement") govern your access to and use of the PoseFit AI mobile application, website, and related services (collectively, the "Service") operated by Issa Yerzhigit ("we", "us", "our").

Please read these Terms carefully before using our Service. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Definitions

"Service" refers to the PoseFit AI mobile application, website, and all related features, content, and services.
"User", "you", "your" refers to the individual person, company, or legal entity that accesses or uses the Service.
"Account" refers to the unique account created for you to access our Service.
"Content" refers to text, images, videos, audio, data, workout routines, AI feedback, and other materials available through the Service.
"Premium Subscription" refers to paid subscription plans offering enhanced features.
"Paddle" refers to Paddle.com Market Limited, our authorized payment processor and Merchant of Record.

2. Acceptance of Terms

By creating an account, downloading our application, or accessing any part of our Service, you confirm that:

You are at least 18 years of age or have parental/guardian consent if you are between 13 and 18 years old.
You have the legal capacity to enter into this binding agreement.
You will comply with all applicable local, state, national, and international laws and regulations.
All registration information you provide is accurate, current, and complete.

3. Service Description

PoseFit AI provides an AI-powered fitness coaching platform that includes:

Real-time AI analysis of exercise form using your device camera
Automatic repetition counting for various exercises
Instant voice and visual feedback on exercise technique
Workout history tracking and progress analytics
Customizable AI trainer personality and coaching style
Exercise library and workout recommendations

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, though we will make reasonable efforts to notify users of significant changes.

4. User Accounts

4.1. Account Creation

To access certain features of the Service, you must create an account. During registration, you must provide accurate and complete information, including a valid email address.

4.2. Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

Use a strong, unique password
Not share your account credentials with any third party
Immediately notify us of any unauthorized access or security breach
Accept responsibility for all activities conducted through your account

4.3. Account Restrictions

You may not use a username or account name that:

Infringes on trademark or intellectual property rights
Impersonates another person or entity
Contains offensive, vulgar, or obscene language
Violates any applicable laws or regulations

5. Subscriptions and Billing

5.1. Free Plan

We offer a basic free tier with limited features that allows you to experience core functionality of the Service at no cost.

5.2. Premium Subscriptions

Premium subscription plans unlock advanced features including:

Unlimited AI form analysis sessions
Advanced workout analytics and detailed progress tracking
Full access to exercise library and custom workout builder
Multiple AI trainer personality options
Priority customer support
Ad-free experience

5.3. Free Trial

New users may be eligible for a 7-day free trial of Premium features. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin, and you will be charged the applicable subscription fee. We reserve the right to modify or cancel free trial offers at any time.

5.4. Automatic Renewal

All Premium subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You authorize us to charge your designated payment method for the renewal fee. The renewal rate will be the same as the initial subscription rate unless you have been notified in advance of a price change.

6. Payment Terms

6.1. Payment Processing

All payments are processed by Paddle.com Market Limited ("Paddle"), who serves as our Merchant of Record. Paddle is responsible for handling all payment transactions, storing payment information, and ensuring PCI-DSS compliance. We do not have access to or store your payment card details. By subscribing to our Service, you agree to Paddle's terms of service and privacy policy.

6.2. Pricing and Currency

Subscription prices are listed on our pricing page and are quoted in United States Dollars (USD) or your local currency as determined by Paddle. Prices may vary by region due to local taxes and currency conversion rates.

6.3. Taxes

You are responsible for any applicable taxes, duties, or government charges. Paddle will calculate and collect applicable taxes (such as VAT, GST, or sales tax) based on your location at the time of purchase.

6.4. Price Changes

We reserve the right to modify subscription pricing at any time. For existing subscribers, price changes will take effect at your next renewal date following at least 30 days' advance notice via email or in-app notification. Your continued use of the Service after a price change constitutes acceptance of the new pricing.

6.5. Payment Failures

If a payment fails due to card expiration, insufficient funds, or other reasons, we will attempt to process the payment again. If payment cannot be processed after reasonable attempts, your Premium subscription may be downgraded to the free plan, and you may lose access to Premium features until payment is successfully processed.

7. Cancellation and Refunds

7.1. Cancellation Process

You may cancel your Premium subscription at any time through:

Your account settings within the application
The Paddle subscription management portal
Contacting our support team at posefit.live@gmail.com

Upon cancellation, your Premium access will continue until the end of your current paid billing period. No partial refunds are provided for the remaining portion of the current billing period.

7.2. Refund Policy

Due to the digital nature of our Service and instant access to Premium features, all subscription purchases are generally non-refundable. However, we may issue refunds in the following exceptional circumstances:

Technical issues preventing access to the Service for an extended period due to our error
Unauthorized charges (you must report these within 30 days of the charge)
Duplicate charges due to processing errors
As required by applicable consumer protection laws in your jurisdiction

Refund requests must be submitted within 14 days of the charge and will be evaluated on a case-by-case basis at our sole discretion. To request a refund, contact posefit.live@gmail.com with your account details and reason for the request. Approved refunds will be processed through Paddle and may take 5-10 business days to appear in your account.

7.3. Free Trial Cancellation

If you cancel during the free trial period, you will not be charged. You must cancel before the trial period ends to avoid being charged for the subscription.

8. User Responsibilities and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree NOT to:

Use the Service in any way that violates applicable laws or regulations
Attempt to gain unauthorized access to any portion of the Service or related systems
Interfere with or disrupt the Service or servers/networks connected to the Service
Use the Service to transmit viruses, malware, or other malicious code
Reverse engineer, decompile, or disassemble any aspect of the Service
Remove or obscure any proprietary notices or labels
Use automated systems (bots, scrapers, etc.) to access the Service without permission
Resell, redistribute, or sublicense access to the Service
Upload or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Impersonate any person or entity or falsely state or misrepresent your affiliation

Violation of these acceptable use terms may result in immediate termination of your account and access to the Service.

9. Intellectual Property Rights

9.1. Our Content and Ownership

The Service and all Content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software code, AI models, algorithms, and user interface design) are owned by PoseFit AI, Issa Yerzhigit, or our licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly in accordance with these Terms. You may not:

Copy, modify, create derivative works from, distribute, or publicly display any Content from the Service
Use any Content for commercial purposes without express written permission
Extract or attempt to extract the source code of our software or AI models

9.2. User-Generated Content

You retain ownership of any workout videos, photos, or other content you upload or create using the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, and display such User Content solely for the purposes of:

Providing and improving the Service
Training and enhancing our AI models
Generating personalized recommendations and feedback
Creating anonymized aggregated data for research and development

You represent and warrant that you own or have the necessary rights to all User Content you submit and that your User Content does not violate any third-party rights.

9.3. Feedback

If you provide us with any feedback, suggestions, or ideas about the Service ("Feedback"), you grant us an unlimited, irrevocable, perpetual, royalty-free license to use such Feedback for any purpose without compensation or attribution to you.

10. Disclaimers and Warnings

10.1. Medical Disclaimer

IMPORTANT: THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

PoseFit AI provides fitness guidance and exercise form analysis for informational and educational purposes only. The Service does not provide medical advice and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. You should always:

Consult with a qualified healthcare provider before beginning any exercise program
Seek medical advice if you have any pre-existing health conditions
Stop exercising and seek medical attention if you experience pain, dizziness, or discomfort
Never disregard professional medical advice or delay seeking it because of information from our Service

10.2. Assumption of Risk

Physical exercise involves inherent risks including but not limited to muscle strains, sprains, fractures, cardiac events, and other injuries. By using the Service, you acknowledge and accept these risks. You agree that you are voluntarily participating in activities and using the Service at your own risk.

10.3. AI Technology Limitations

Our AI technology is continuously improving but is not infallible. The AI analysis and feedback provided:

May not always be 100% accurate or complete
Depends on camera quality, lighting, and positioning
Should be used as guidance, not absolute instruction
Cannot replace supervision by qualified fitness professionals

We are not responsible for any injuries or damages resulting from following AI-generated recommendations or feedback.

10.4. Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

The Service will be uninterrupted, secure, or error-free
Defects will be corrected
The Service will be available at any particular time or location
The results obtained from using the Service will be accurate or reliable

10.5. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of third-party services is at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL POSEFIT AI, ISSA YERZHIGIT, OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, revenue, data, or business opportunities
Personal injury or property damage
Loss of goodwill or reputation
Service interruptions or system failures
Errors or inaccuracies in Content or AI feedback
Any damages arising from your use of or inability to use the Service

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless PoseFit AI, Issa Yerzhigit, and our respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your violation of these Terms or any applicable law or regulation
Your use or misuse of the Service
Your User Content or any content you submit or transmit through the Service
Your violation of any rights of another person or entity
Any injury or damage you suffer while using the Service
Unauthorized access to your account due to your failure to safeguard credentials

13. Termination

13.1. Termination by You

You may terminate your account at any time by:

Using the account deletion feature in your account settings

Upon termination, your right to use the Service will immediately cease. If you have an active Premium subscription, it will continue until the end of the current billing period without refund.

13.2. Termination by Us

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

Violation of these Terms
Fraudulent, abusive, or illegal activity
Extended periods of inactivity
Requests by law enforcement or government agencies
Unexpected technical or security issues

13.3. Effect of Termination

Upon termination of your account:

Your right to access and use the Service will immediately cease
We may delete your User Content and account data
You remain liable for all obligations incurred prior to termination
Sections of these Terms that by their nature should survive will survive termination

14. Modifications to Terms and Service

14.1. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to the new terms taking effect by:

Sending an email to the address associated with your account
Posting a prominent notice within the Service
Updating the "Effective Date" at the top of these Terms

What constitutes a "material change" will be determined at our sole discretion. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those changes. If you do not agree to the new terms, you must stop using the Service.

14.2. Changes to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Governing Law and Dispute Resolution

15.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions.

15.2. Dispute Resolution

Any disputes, claims, or controversies arising out of or relating to these Terms or the Service shall be resolved as follows:

Informal Resolution:
We encourage you to contact us first at posefit.live@gmail.com to resolve disputes informally.
Arbitration/Court:
If informal resolution fails, disputes shall be resolved in the competent courts of the Republic of Kazakhstan.

15.3. Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

We do NOT store or have access to your full payment card details. Paddle is PCI-DSS compliant and responsible for the security of your payment information. 1.3. Fitness and Usage Data

Data generated when you use our AI fitness features:

Exercise sessions (type, duration, repetitions counted)
Workout history and progress metrics
AI-generated form analysis and feedback
Body position data captured during exercise sessions (processed in real-time, not permanently stored unless you save videos)
Performance statistics and achievements
AI trainer preferences and settings

1.4. Camera and Media Access

To provide real-time form analysis:

Camera access for live exercise analysis (video feed processed locally on your device)
Video recordings (only if you choose to save workout sessions)
Photos (only if you choose to upload progress photos)

Important: Camera feed during workouts is processed in real-time for AI analysis and is not automatically stored or transmitted to our servers unless you explicitly choose to save a video.

1.5. Automatically Collected Information

Technical information collected automatically when you use the Service:

Device information (model, operating system, unique device identifiers)
IP address and general location (city/country level)
Browser type and version
App usage statistics (features used, time spent, session frequency)
